The Black Rock Wagyu website (the "Site") is a service of Black Rock Wagyu ("we" or "us"). These Conditions of Use, along with any other terms and conditions that may appear on the Site from time-to-time (collectively, "Conditions"), set forth the terms and conditions under which you may use and access the Site.

BY ACCESSING THE SITE, YOU AGREE TO THESE CONDITIONS. IF YOU DO NOT AGREE TO THESE CONDITIONS (WITHOUT MODIFICATION), YOU ARE NOT AUTHORIZED TO ACCESS OR OTHERWISE USE THE SITE OR ORDER PRODUCTS FROM THE SITE.

1. Use of Site and Content

1.1 Use of Site. You may access and use the Site solely for your personal use in accordance with these Conditions. You agree not to access or use the Site in any manner that is prohibited by these Conditions or is otherwise unlawful. We reserve the right, in our sole discretion, to cancel orders and refund your money, to refuse to conduct business with you, or terminate your access to the Site at any time, with or without notice.

1.2 Use of Content. You are granted a limited license to print or copy information displayed on the Site (text, photographs, images, and logos) for your personal, noncommercial use only.

1.3 Restrictions. You agree not to distribute, republish, or use any Content for commercial purposes without express written permission from Black Rock Wagyu. You further agree not to use data mining, robots, or similar data gathering methods on the Site.

1.4 Product Information. We make every effort to display the attributes of our Wagyu products accurately. However, actual colors and visual depictions depend on your monitor and connection; we cannot guarantee an exact visual match. Prices are quoted in U.S. Dollars and are valid only in the United States.

2. Registration

If you register for an account, you agree to provide true and accurate information. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

3. Linking and Third-Party Dealings

We may provide links to external sites for your reference. Black Rock Wagyu has no control over these third-party sites and is not responsible for their content or privacy policies.

4. Intellectual Property

All Content on this site is owned by Black Rock Wagyu or its suppliers and is protected by copyright and trademark laws. Our stories, photos of our cattle, and our brand marks may not be used without permission.

5. Submissions & Feedback

5.1 Online Submissions. If you post comments or reviews (Online Submissions), you grant Black Rock Wagyu a royalty-free, perpetual license to use that content for promotional or advertising purposes.

5.2 Unsolicited Ideas. Please do not send unsolicited ideas for advertising or new products. If you do send them, they become the property of Black Rock Wagyu without compensation to you. We do, however, welcome specific feedback on our existing products via our Contact Us page.

6. Payment

We accept all major credit cards, PayPal, Shop Pay, and Apple Pay. You represent and warrant that you have the legal right to use any payment method utilized in connection with a transaction. Payment transactions are processed by our third-party payment processors in accordance with our Privacy Policy.

7. Indemnification

You agree to indemnify and hold harmless Black Rock Wagyu, its officers, and employees from any liability or costs (including attorney's fees) arising out of your use of the Site or any breach of these Conditions.

8. No Warranties

The Site is provided on an "AS IS" and "AS AVAILABLE" basis. Black Rock Wagyu disclaims all warranties, express or implied. We do not warrant that product descriptions or prices are error-free. We reserve the right to cancel and refund any orders at any point due to inaccuracies or availability.

9. Limitation of Liability

In no event shall Black Rock Wagyu be liable for any direct, indirect, or consequential damages resulting from your use of the Site or the purchase of our products, even if we have been advised of the possibility of such damages.

10. Governing Law and Jurisdiction

These Conditions are governed by the laws of the State of Iowa, USA. You agree that any legal action arising out of your use of this Site shall be brought in the state or federal courts located in Wapello County, Iowa.

11. Miscellaneous

These Conditions constitute the entire agreement between you and Black Rock Wagyu. If any portion is found to be invalid, the remainder remains in full effect. You agree that any cause of action must commence within one (1) year after the cause of action arises.
